Terms of Service

These Terms of Service ("Terms") govern your access to and use of tiankriek.com (the "Site") and any content, indicators, tools or materials made available through it, provided by Kriek Institutional Research, operated by Tian Kriek in Portugal (NIF 301422362) ("we", "us", "our"). By using the Site or downloading any material, you agree to these Terms. If you do not agree, please do not use the Site.

1. Educational purpose only

The Site provides trading education and technical tools (including chart indicators for MetaTrader 4, MetaTrader 5 and TradingView). These are teaching aids designed to illustrate a methodology. They do not predict future results and do not place trades on your behalf. You are solely responsible for your own trading decisions.

2. Risk warning

Trading financial instruments — including CFDs, forex, commodities, stocks and cryptocurrencies — carries a high level of risk and may not be suitable for all investors. You may lose some or all of your invested capital. Past performance, including any results shown on the Site or on third-party verification services such as Myfxbook, is not indicative of future results. Never trade with money you cannot afford to lose. Consider seeking advice from an independent, licensed financial adviser.

3. Licence to use the indicators

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the indicators for your own individual trading and educational use.

You may not:

• Resell, redistribute, sublicense or commercially exploit the indicators or content;
• Decompile, reverse-engineer or attempt to extract the source code of the compiled indicators;
• Represent the tools or strategy as your own;
• Use the materials in any unlawful manner.

All intellectual property in the Site, the indicators and the content remains the property of Kriek Institutional Research.

4. No warranty

The Site and all materials are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or that the indicators will be error-free or uninterrupted. You use them at your own risk.

5. Limitation of liability

To the maximum extent permitted by law, Kriek Institutional Research and Tian Kriek shall not be liable for any direct, indirect, incidental, consequential or special damages — including trading losses, loss of profits or loss of data — arising from your use of, or inability to use, the Site or its materials, even if advised of the possibility of such damages.

6. Third-party links and services

The Site links to third-party platforms (for example TradingView, MetaTrader, KriekTrade.io and mentorship services). We are not responsible for the content, terms or privacy practices of those third parties. Your use of them is governed by their own terms.

7. Availability and changes

We may modify, suspend or discontinue any part of the Site or the indicators at any time without notice. We may also update these Terms from time to time; the "Last updated" date reflects the latest version. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we handle your personal data.

9. Governing law

These Terms are governed by the laws of Portugal. Any dispute arising from or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Portugal, without prejudice to any mandatory consumer-protection rights you may have.
